Succession
A succession, known as “probate” in other states, is the legal process of transferring a person’s estate or property to the heirs after death. Whether the person had a valid will determines what type of succession will take place.
There are two types of successions in Louisiana:
Testate: When the deceased person left a valid will an estate is considered testate. The assets are transferred according to the will.
Intestate: When the deceased person did not leave a valid will. Determining what share of assets an individual inherit depends on whether if the deceased person is married, has living children, parents, or other close relatives and is subject to Louisiana intestate succession laws.
